Route 2

Registration under the Hindu Marriage Act

Before you travel to any office

What both of you must bring

This is the list that decides whether your file moves on the day or comes back. Offices differ in detail, so confirm the final combination for your district — we do that check for you before you book.

  • Age proof — birth certificate, matriculation certificate or passport. The bride must be 18 or above and the groom 21 or above.
  • Identity proof — Aadhaar, passport, voter ID or driving licence for both parties.
  • Address proof — at least one of you should be able to show residence in the district where you apply.
  • Passport-size photographs — carry extra; different forms consume different numbers.
  • Two witnesses with their own original ID and address proof. For HMA registration many SDM offices ask for a gazetted officer as one of the attesting witnesses — check your district.
  • Affidavits of marital status, date of birth and address, on stamp paper and notarised.
  • If previously married — the decree of divorce or the death certificate of the former spouse, in original.
  • If a foreign national or NRI — passport, valid visa, and a no-impediment certificate or its equivalent from the embassy, plus proof of 30 days' residence for the Special Marriage Act route.

It depends on the Act. Under the Special Marriage Act the 30-day notice period is fixed by statute, so budget roughly 45 to 60 days from notice to certificate. Registration of an existing marriage under the Hindu Marriage Act has no notice period and is indicatively completed in about 15 days at the SDM office, sometimes faster when the file is complete. An Arya Samaj ceremony itself is finished the same day.

Not on its own. The Arya Samaj certificate is evidence that the ceremony took place. For a passport, a spouse visa, a bank record or an Aadhaar update you need the government marriage certificate issued by the SDM after registration. Anyone who tells you the mandir certificate alone is enough is setting you up for a rejection.

Yes, when the ceremony is genuinely performed and both parties are eligible. Section 7 of the Hindu Marriage Act 1955 recognises marriage by customary rites, and the Arya Marriage Validation Act 1937 specifically validates marriages between Arya Samajists. Validity depends on the ceremony actually happening and on eligibility, not on the certificate.

The bride must have completed 18 years and the groom 21 years. Age proof is the single most common reason a file is refused, so the birth certificate, matriculation certificate or passport is checked first. Proposals to change the age for women have been discussed but the requirement above is what offices apply.

Aadhaar is the most convenient identity and address proof but it is not the only acceptable one. Passport, voter ID, driving licence, bank records and utility bills are accepted depending on the office and the document being proved. What matters more is that the name spelling matches across your documents.

Yes. No caste certificate is required to marry, and inter-caste marriage between two eligible adults is fully lawful. Inter-state is equally fine; what matters is jurisdiction, meaning at least one of you should be able to show residence in the district where you apply.
